Instnt Inc. (“Instnt”, “us,” “our,” or “we”) is committed to protecting your personal information. This Privacy Policy covers the collection and use of information obtained through our website, www.instnt.ai (the “Website”), and the personal information we collect and process at the direction of Clients (defined below) and through their use of our services. Why Do We Collect Personal Information?

Instnt is a business that provides a digital service to many consumer-facing businesses and companies (“Clients”). Our Clients come to Instnt to verify an individual’s identity.

Personal Information We Collect

We collect personal information on you in a variety of ways, such as when you:

  • Correspond with us by phone or email,
  • Request support for Instnt products,
  • Submit details through our Website,
  • Use our products and services, or
  • Engage with one or more of our Clients that use our products and services.

We may also collect supplemental information about you from other sources, including our vendors and publicly available sources of information.

The personal information we may collect includes the following:

Contact or request submissions. When you use the Contact Us page on our Website, request a quote, or use another contact or request form, we collect personal information from you to evaluate and respond to your request, and we may also use the information to improve our services. The information we collect may include your name, email address, job title, company name, telephone number, and the content of any messages.

Communications. We receive the personal information that you submit through your communications with us by email, phone, or physical mail and we process this information to respond to you and in the normal course of our business operations.

Service-related information. Our Clients provide your personal information that is necessary for our service to work and then we use that personal information to verify that the information is correct and to provide our services. In order for our Client to provide your personal information, you would have previously provided permission to our Client to send certain personal information to Instnt. That is, you must have opted in to provide the personal information to the Client in order for Instnt to receive the data necessary to provide its identity verification processing service. The personal information we collect may include, without limitation, a person’s or business’ name, usernames, passwords, email addresses, phone numbers, date of birth, national ID information (such as Social Security number, driver license information, passport information, etc.), employer name, geographic location (latitude and longitude), images, and other information necessary to access accounts or profiles with third-parties, including, but not limited to, social media sites.

Business contacts. We may receive contact information (including your name, telephone number, and email address) and/or professional or business-related information (including your business address), through our interactions with you as a Client or in a business-to-business capacity, such as when your business provides services to us, or when we work together on a project, or when we discuss business opportunities. We may contact you with information about our business dealings, news, and opportunities, and we may use your information in the normal course of our business operations.

Social media. If you post information on a webpage we establish on a social media platform, we may use the information you provide for purposes of providing a response, to promote our business and services, and otherwise in the normal course of our business operations. We may collect personal identifiers, such as your social media username, and other personal information that you have made available to us through the webpage we established on the social media platform, in accordance with the platform rules and/or applicable law. Note that the third-party operators of social media websites also receive such information, and their use of your personal information is governed by their own privacy policies.

Job applicants. Job application information may be collected by us directly through the Website, in-person, or by email, or job application information may be collected on our behalf by our contracted third-party administrator(s) for applicant tracking purposes and by background check providers. These third-party administrators are permitted to process the information you provide only for purposes of providing services to us.

Automated data collection: cookies and similar technologies. When you use our Website, we and our third-party partners, such as analytics providers (including Google Analytics), collect information by automated means.

We may use cookies and similar technologies to collect personal identifiers (such as your IP address), information about your device (such as your browser characteristics, device IDs and characteristics, and operating system version) and information concerning your usage of our Website (including the link you used to reach a given webpage). We use this information to determine how many users have visited particular webpages, viewed particular content, or opened messages or alerts, and we may also use such information to improve the performance of the Website, to improve our marketing activities, and to enforce our terms and prevent malicious conduct.

How We Use Personal Information

In addition to the uses described above, we also use your personal information:

  • to present, operate or improve the Website, its content, and our services, including analysis of Website activity;
  • to inform you about the services and products available from Instnt;
  • to develop new services and products;
  • to customize or tailor your experience of the Website;

  • to communicate about, and administer your participation in, special programs, online campaigns, and other offers or promotions, and to deliver pertinent emails;

For job applicants, we process your information to review your job application and for other employment-related purposes consistent with applicable law, including to contact you regarding your application and/or to contact you about other job openings that we believe may be of interest to you.

Information automatically collected through the Website may be aggregated for reporting on usability, performance, and effectiveness. We may also use such information to analyze your usage of our Website and for other research that helps us improve the services and products we offer.

Information We Disclose

We disclose personal information for the purposes described above to the following:

Vendors and service providers. We may disclose personal information with our vendors working for us to provide products or services to our Clients, including providing payment processing services, but only as necessary for the provision of those products and services. Examples of these companies include financial and non‐financial companies that perform services such as data processing, administrative services, regulatory support, legal services, and other service providers we engage from time to time. The vendors and service providers whom we share the personal information with are required to keep this information confidential and generally may not use such information for any purpose other than to help us provide requested products and services to our Clients.

Affiliates. Instnt has multiple affiliates. If an affiliate company needs access to certain personal or customer information in order to carry out certain functions on our behalf and for our business purposes (including consulting, sales, customer support operations, authentication services, and technical support or services), they do so under our instructions. All affiliate companies with whom we share personal or other customer information have their own privacy policies, however, they are expected to protect your information in a manner that aligns with the protocols described in our Privacy Policy. We do not share your personal information with affiliates for their own benefit unless you have given us your consent.  We may share information among our affiliates, as permitted by law, in order to better serve your financial needs.

Third parties and marketing and analytics partners. Instnt has relationships with third-party companies and marketing and analytics partners. Examples of these companies include Google in connection with its Google Analytics services.

Consent and as directed by you.

  • We may disclose personal information should you decide to participate in certain promotions and special offers when the nature of the promotion or special offer requires us to gather and share your personal information (such as your mailing address) with a third-party for delivery of goods or services.
  • We may disclose information to third-parties about your account or the transactions you make if you give us your written permission.

Legal and similar disclosures. We may disclose your Personal Information for legal reasons. Specifically you information may be disclosed:

  • to law enforcement, and officials, or other third parties when we are compelled to do so by a subpoena, court order, or similar legal procedure, or when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of any of our terms and conditions or any other applicable policies;

We may attempt to notify you about legal demands for your personal information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

Merger, sale, business or other asset transfer. We may disclose your personal information in the event of a business transfer. If we establish a new related entity, are acquired by or merged with another organization, or if substantially all of our assets are transferred to another organization, personal information about our users is often a transferred business asset. In the event that Instnt itself or substantially all of our assets are acquired, personal information about our users may be one of the transferred assets.

Access to Information and Your Choices

Whenever we collect your personal information, we take steps to help ensure that it is accurate, complete, and up-to-date. You may request access to such personal information about yourself that Instnt holds by contacting us. Additionally, if your personal information changes, or if you believe the information Instnt holds is inaccurate, you may request to correct, update, amend or delete/remove inaccurate information by contacting us; except where the burden or expense of providing access would be disproportionate to the risks to the privacy of the individual in the case in question or where the rights of persons other than the individual would be violated.

You may request that your personal information be deleted. Any requests for data destruction will be responded to in accordance with applicable policies, regulations, certifications, and contractual obligations.

Data Security

Instnt will take reasonable steps to protect your personal information and has implemented reasonable physical, electronic, and managerial procedures designed to safeguard, secure and protect information from loss, misuse, unauthorized access, disclosure, alteration, destruction, and malicious or unintentional action. However, the Instnt cannot completely guarantee the security of Information on or transmitted via the Internet because no method of electronic transmission or storage is 100% secure.

Links to Third-Party Websites

Our Website may provide links to third-party websites for your convenience and information. Our inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators. If you access those links, you will leave our Website. We do not control those websites or their privacy policies or practices, which may differ from ours.

“Do Not Track” Policy

California law requires us to inform you how we respond to web browser Do Not Track (“DNT”) signals. We do not respond to such signals at this time.

Children Under the Age of 16

Instnt’s services are not intended for access or use by, and we do not knowingly collect personal information from, children under 16 years of age. If you are under 16 years of age, do not access, use or provide any information on our Website, including completing the online registration process for the service, or provide any information about yourself to us, including your name, address, telephone number, email address or any other personally identifiable information. If you believe we might have any information from or about a child under 16 years of age, please contact us at privacy@instnt.ai.

Privacy Rights

Certain jurisdictions have specific legal requirements and grant privacy rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. For example, you may have the right to review, correct, and delete personal information we have about you, or to consent or withdraw consent to certain uses or sharing of personal information. Please note that, when you make a request, we may require that you provide information and follow procedures so that we can verify your identity (and the applicable jurisdiction). The verification steps we take may differ depending on your jurisdiction and the request. Changes to This Privacy Policy

This Privacy Policy may be amended from time to time, and the revised version will be effective when it is posted and will apply to personal information received after that date. If we make any material changes, we will provide notice of such changes on the Website or in any other pertinent location where this Privacy Policy may be posted for a reasonable period of time (which we estimate will be approximately two weeks). We encourage you to review this Privacy Policy periodically, especially if you do not use the Website regularly.
